T1 Exclusive Membership. Terms & conditions.
These Terms and Conditions govern the use of T1 Exclusive Membership services provided by Tier One Electrical & Air Conditioning.
1. Membership
1.1 Eligibility
Membership is open to individuals aged 18 years or older, or individuals aged 16–17 years with parental or guardian consent.
1.2 Membership types
Tier One Electrical & Air Conditioning offers various membership options, including but not limited to monthly and annual memberships. Each membership type has specific terms and conditions.
1.3 Registration
To become a Member, individuals must complete the registration process, which includes providing accurate personal information, signing this Agreement, and paying the required fees.
2. Membership fees
2.1 Payment terms
Members shall pay the membership fees as per the agreed terms, which may include a one-time registration fee, an initial payment, and recurring monthly or upfront payments.
2.2 Payment method
Members may pay by credit card, electronic funds transfer, or any other payment method accepted by the Company.
2.3 Fee adjustments
Tier One reserves the right to adjust membership fees upon providing reasonable notice to Members.
3. Membership terms
3.1 Duration
All memberships are a 12-month lock-in contract. After 12 months your membership will be renewed automatically unless requested otherwise within the 12-month contract.
3.2 Termination
Tier One has the right to terminate your membership at any time. Specifically:
- 3.2.1 — After 3 failed/missed payments, Tier One has the right to terminate your membership.
- 3.2.2 — Tier One has the right to issue lifetime bans for breaching any terms and conditions.
- 3.2.3 — After the 2nd consecutive day of works, Tier One has the right to delay any further works for 7 days after the 2nd consecutive day of work.
3.3 Suspension
Members may request a temporary suspension of their membership due to illness, injury, or other valid reasons. The Company may approve or deny such requests at its sole discretion.
3.4 Membership transfer
Membership is non-transferable and may not be assigned to any other individual.
4. Member responsibilities
4.1 Code of conduct
Members shall abide by the Company's code of conduct, which includes treating staff and other Members with respect.
4.2 Health and safety
Members are responsible for assessing their own physical condition and suitability before engaging Tier One services.
4.3 Indemnification
Members shall indemnify and hold the Company harmless from any claims, damages, or liabilities arising while Tier One is conducting work, except where caused by the Company's negligence or wilful misconduct.
5. Company's rights and liabilities
5.1 Access
Tier One shall provide Members with access to services during operating hours, subject to any necessary maintenance or repairs.
5.2 Limitation of liability
Tier One shall not be liable for any injuries, accidents, or damages suffered by Members within the area of works, except where caused by the Company's negligence or wilful misconduct.
6. Privacy
6.1 Personal information
The Company shall collect, store, and use personal information provided by Members in accordance with applicable privacy laws.
7. Governing law and dispute resolution
7.1 Governing law
This Agreement shall be governed by and construed in accordance with the laws of Australia.
7.2 Dispute resolution
Any disputes arising out of or relating to this Agreement shall be resolved through good-faith negotiation. If no resolution is reached, the parties agree to submit the dispute to arbitration.
